Esta revisión narrativa aborda la evolución histórica y legal de las voluntades anticipadas a nivel global y local desde su surgimiento. Parte del principio de autonomía en la bioética moderna y su relación con la vulnerabilidad del paciente, así como la consideración de la muerte por parte de los profesionales de la salud. Destaca el papel esencial del documento de voluntades anticipadas como una herramienta valiosa en la relación médico paciente-familia, siendo fundamental para comprender la perspectiva del paciente. Se define (...) el documento considerando la literatura médica y se discute su aplicación, subrayando la importancia de no esperar hasta un deterioro clínico avanzado para su implementación. La revisión también examina la legislación nacional e internacional, así como el conocimiento médico actual, con el objetivo de facilitar decisiones consensuadas entre todas las partes involucradas en el cuidado del paciente. O presente texto tem como objetivo discutir expressões das masculinidades negras a partir da poética do rap na produção do rapper paulista Criolo.

O artigo examina a ideia da filosofia com base no questionamento sobre a esfera pré-teoréticada vivência do mundo do entorno (Umwelterlebnis) na segunda parte da preleção acadêmica intitulada“A ideia da filosofia e o problema da visão de mundo” de 1919 (GA 56/57, p. 63-76). Após desqualificar,na primeira parte da preleção, a teleologia crítica dos neokantianos da Escola de Baden a partir danecessidade de interrogar o que é dado quando se fala justamente de doação (material ou ideal nessadoutrina), Martin Heidegger privilegia (...) o Umwelt como esfera apreendida com base em uma “ciência préteórica originaria”. Examinando, fenomenologicamente, as vivências da pergunta (Frageerlebnis), dacátedra (Kathedererlebnis) e destacando o caráter de apropriação (Ereignis) de tais vivências (§§ 13, 14,15 do curso em questão), Heidegger preserva o caráter mundanizante ao verbalizar o substantivo Welt(“es weltet”) no exemplo da vivência da cátedra. Assim procedendo, ele rompe com o primado doteorético (isto é, com a relação entre percepção e conhecimento) em favor da dimensão da“significatividade” da qual parte com o objetivo de pleitear nesse período uma ciência não teórica paraentender o ver fenomenológico como um “compreender intuitivamente” ou como uma “intuiçãohermenêutica”. Este artículo trata, en un primer momento, de presentar los puntos fundamentales de la propuesta de Deleuze y Guattari en torno a la literatura menor, para pasar, en un segundo momento, a mostrar cómo, en Tirano Banderas, Del Valle-Inclán crea una literatura menor que permite al lector experimentar distintas maneras de enunciación que rompen formas tradicionales de creación literaria y expresan intensidades y rupturas en el mecanismo maquínico de ejercicio del poder en América Latina. La evidencia comparativa reciente sugiere que algunas especies no humanas sienten empatía hacia otros congéneres, la cual es una capacidad necesaria para la presencia y evolución de la moralidad. Por otro lado, la Hipótesis del Cerebro Social plantea relaciones entre la evolución de la neocorteza cerebral en primates y el tamaño de sus grupos sociales. Este artículo vincula estas ideas al señalar que: (i) la empatía y la moralidad son subproductos de la expansión de la neocorteza cerebral, y (ii) la (...) función de tales capacidades es facilitar la cooperación entre individuos, aumentando su cohesión social. Recent comparative evidence suggests that some nonhuman species feel empathy towards fellow group members and empathy is a necessary capacity for the presence and evolution of morality. On the other hand, the Social Brain Hypothesis suggests relationships between the evolution of brain's neocortex in primates and the size of their social groups. This paper links these ideas by suggesting that (i) empathy and morality are by-products of the expansión of brain's neocortex, and that (ii) the function of such capacities is to facilitate cooperation between individuals, increasing their social cohesion. Este artículo propone estudiar la relación que hay entre filosofía y literatura para Deleuze y Guattari. La tesis de central muestra que se debe captar el diferencial justo donde ambas, filosofía y literatura están conectadas, a saber, en el acontecimiento. Por el tratamiento que cada una tiene del acontecimiento, resulta que ambas posibilitan, a su modo, nuevos cambios en la vida de los humanos. En la primera parte se expone la concepción del arte y de la filosofía, a partir del (...) bloque de sensación y del concepto. En la segunda parte, se expone la particularidad de la creación literaria respecto del lenguaje, la escritura, el sentido y el acontecimiento. En la tercera sección se precisa que la línea de fuga completa, en términos temporales, el acontecimiento en la literatura. From the most prominent thinkers in Latin American philosophy, literature, politics, and social science comes a challenge to conventional theories of globalization. The contributors to this volume imagine a discourse in which revolution requires no temporalized march of progress or takeovers of state power but instead aims at local control and the material conditions for human dignity.

O presente artigo pretende analisar, a partir do liber II do De Vita Caesarum, de Suetônio, o perfil do imperador Augusto, promovendo uma discussão sobre os aspectos linguísticos e estilísticos da obra, discorrendo sobre sua contribuição ainda não devidamente valorizada para o desenvolvimento da historiografia moderna, cotejando, analisando e discutindo traduções de modo a propor alteração em diversos fragmentos.

This study investigates the possible effects of pre-term births and low birth weight on infant mortality rates (IMRs) over a 15-year period in Ribeirão Preto, Brazil, based on surveys carried out in 1978/79 and 1994. The 1978/79 survey included 6750 births over a 12-month period and the 1994 survey 2846 births over a 4-month period. Infant deaths were retrieved monthly from the city register. Infant mortality rate decreased from 36·6 to 16·9 deaths per 1000 over 15 years. The decrease in (...) IMR was larger in the 25000·63); it increased to 0·57 (95% CI 0·350·97) when adjusted for length of gestation and other variables. The increase in pre-term births and low birth weight may have had, at most, a marginal effect on the IMR. Progress in the care of newborns may have decreased the mortality risk, but even mild pre-term birth still has an impact on infant mortality. There is room for further improvement in IMR by tackling the high rates of pre-term birth. (shrink)

This article introduces practical and theoretical investigations in fields of art and technology related to biotelematics, hybridization and transcultural experimentation based on research carried out over the last four years at the Nucleus of Art and New Organisms (NANO). We will approach this subject by considering three main points of view: field theory (Ascott 1980; Nóbrega 2009); the concept of coherence (Ho 1993; Ho & Popp 1989; Simondon 1980); and the state of connectedness (Ascott 2006). These will act as integrative (...) models for the understanding of an emerging hybrid organic structure presented as an aesthetic organism (Nóbrega 2009). The concept of field theory is applied as a working model for the systemic role of information within the immaterial, invisible, dynamical flow that intercommunicates natural (i.e. humans and other living systems) and artificial (i.e. machine) organisms in the process of invention, as well as in the fruition of artwork. In terms of the concept of coherence, we propose the idea of artworks as transducers of energy; more specifically, as resonators of coherent fields that interconnect the artist and audience in an integrated, dynamical whole. Furthermore, we approach the state of connectedness as a fundamental notion for the dynamics involved in the invention, exhibition and absorption of contemporary artworks. NANO Lab’s involvement with artistic research is not only understood as a physical space for experimentation, but also as an environment in which our practice reflects concepts applied in artistic work. In this sense, we can highlight two theoretical references (other than Roy Ascott’s work) which guide this methodology: Humberto Maturana (2001; Varela & Maturana 1992) and the idea of a conserved ‘autopoiesis’, a systematic medium (space) in which all recursive dynamics of reciprocal interactions occur to sustain the survival of life, processes and systems, and where technology can be conceived as a powerful instrument/medium to expand our knowledge about structural and sensitive coherences within living and non-living systems; and, Jorge de Albuquerque Vieira’s (2006; 2009) approach to art as a type of knowledge related to any process that guarantees the permanence or survival of a system based on three major characteristics for the survival of an open system – sensitivity (to operate information flows), memory (to transfer and retain information), and capability (to elaborate or prepare information according to its needs). Este estudo visa a analisar o papel da música na obra Dona Flor e seus dois maridos, de Jorge Amado. Evidenciada por referências de acompanhamento nos títulos dos capítulos, citações de músicas e cantores reais inseridos como personagens, assim como em vários momentos importantes na obra, a música desenvolve uma relação dialética, representada principalmente por Vadinho e Teodoro. A partir desses dois personagens, dois mundos se opõem: o popular, da malandragem, do amor sensual, e o erudito, da seriedade, do (...) amor compromissado e respeitador. The statue and the lump of clay that constitutes it fail to share all of their kind and modal properties. Therefore, by Leibniz’s Law, the statue is not the lump. Question: What grounds the kind and modal differences between the statue and the lump? In virtue of what is it that the lump of clay, but not the statue, can survive being smashed? This is the grounding problem. Now a number of solutions to the grounding problem require that we substantially (...) revise our view of reality. In this paper, I provide a solution to this problem that does not require such a revision. I then show how my solution to the grounding problem can solve a related problem and answer a related question. The upshot is that the solution I offer is not only non-revisionary, but also fruitful. Standard approaches to ontological simplicity focus either on the number of things or types a theory posits or on the number of fundamental things or types a theory posits. In this paper, I suggest a ground-theoretic approach that focuses on the number of something else. After getting clear on what this approach amounts to, I motivate it, defend it, and complete it.

In this paper, I both propose and discuss a novel account of truthmaking. I begin by showing what truthmaking is not: it is not grounding and it is not correspondence. I then show what truthmaking is by offering an account that appeals both to grounding and what I call ‘deep correspondence’. After I present the account and show that it is an account that unifies, I put it to work by showing how it can overcome an objection to truthmaking, how (...) we can get truthmaking from correspondence, what it says about truthmaker necessitation, and how it can explain a connection between truthmaker maximalism and pluralism about truth. Truthmaker says that things, broadly construed, are the ontological grounds of truth and, therefore, that things make truths true. Recently, there have been a number of arguments purporting to show that if one embraces Truthmaker, then one ought to embrace Truthmaker Maximalism—the view that all non-analytic propositions have truthmakers. But then if one embraces Truthmaker, one ought to think that negative existentials have truthmakers. I argue that this is false. I begin by arguing that recent attempts by Ross Cameron and (...) Jonathan Schaffer to provide negative existentials with truthmakers fail. I then argue that the conditional—if one embraces Truthmaker, the one ought to embrace Truthmaker Maximalism—is false by considering worlds where very little, if anything at all, exists. The conclusion is that thinking that negative existentials do not have truthmakers, and therefore rejecting Truthmaker Maximalism, need not worry Truthmaker embracers. (shrink)

Divine Simplicity has it that God is absolutely simple. God exhibits no metaphysical complexity; he has neither proper parts nor distinct intrinsic properties. Recently, Jeffrey Brower has put forward an account of divine simplicity that has it that God is the truthmaker for all intrinsic essential predications about him. This allows Brower to preserve the intuitive thought that God is not a property but a concrete being. As I will use the term, an object is a mereological sum of some things just in case those things compose it simply in virtue of existing. In the first half of this paper, I argue that there are no sums. The key premise for this conclusion relies on a constraint on what, in certain cases, it takes for something to ground, or metaphysically explain, something else. Through a close examination of philosopher Leopoldo Zea's historicist phenomenology, Mario Saenz offers fresh insights into the role of Mexican intellectuals in the creation of a Latin American "philosophy of liberation". While this philosophy of liberation has been widely recognized as the most intellectual political ideology to emerge from Latin America this century, few scholars have specifically explored the Mexican roots of this intellectual movement. Saenz redresses this imbalance by placing Zea and his contemporary intellectuals firmly within the context of (...) post-revolutionary Mexico, a political and social landscape that fostered criticisms of colonial and neo-colonial structures of dependence. In this paper, I advance a lesser known counterfactual principle of grounding in a new kind of way by appealing to properties and the work they do. I then show that this new way of arguing for this principle is superior to another way, describe some of the work this principle can do, defend my use of this principle, and conclude with remarks on why principles like it are needed.

As it is presently employed, grounding permits grounding many things from one ground. In this paper, I show why this is a mistake by pushing for a uniqueness principle on grounding. After arguing in favor of this principle, I say something about it and kinds of grounding, discuss a similar principle, and consider its import on a formal feature of grounding, ontology, and ontological simplicity.

Although US and European research has documented improvement in earnings quality associated with corporate governance characteristics, the situation in Latin America is questionable, given the business environment in which firms operate, which is characterized by controlling family ownership and weak legal protection. The purpose of this study is to examine the relation between the internal mechanisms of Corporate Governance and Earnings Management measured by discretionary accrual. We use a sample of listed Latin American non-financial companies from the period 2006–2009. Our (...) results show how in the Latin American context the role of external directors is limited and that Boards which meet more frequently take a more active position in the monitoring of insiders, so showing a lower use of manipulative practices. In addition, we find a non-linear relation between insider ownership and discretionary accruals, also pointing to the fact that ownership concentration may be a manipulative practices constrictor mechanism only when the ownership of main shareholders is moderate. The findings have important policy implications since this is, to the best of our knowledge, the first study to analyze the relation between the effectiveness of the government and the earnings management behavior. As policy implications, we document how when a country implements controls aimed at reducing corruption, strengthening the rule of law or improving the effectiveness of government, this leads to a reduction in firm earnings management. Nancy Jecker’s essay Nothing to be Ashamed of: Sex Robots for Older Adults with Disabilities 1 presents a provocative application of the capabilities approach. Her ethical argument for providing access to sex robots for older adults with disabilities proceeds in five parts: 1. Older adults frequently suffer disabilities that impair sexual functioning. 2. The ability to function sexually is linked to central human capabilities, including: the ability to generate a personally meaningful life narrative; be physically, mentally and emotionally healthy; experience (...) bodily integrity; feel and express a range of human emotions; affiliate deeply with others; and reflect on and choose a plan for their life. 3. Society should take reasonable steps to support these human capabilities at a minimal threshold as part of a broader duty to respect human dignity. 4. Providing access to sex robots comprises part of reasonable efforts to support the six capabilities at a minimal threshold. 5. Therefore, society ought to make reasonable efforts to ensure access to sex robots for older adults with disabilities that impair sexual functioning. I am sympathetic to this line of reasoning, having proposed a series of legal reforms that would facilitate sexual expression among older adults with cognitive impairments as well.2 3 …. (shrink)

Bioethical Proposals to Face Social and Ethical Problems Generated by Neglected Infectious Diseases Propostas bioéticas ante os problemas sociais e éticos que geram as doenças infecciosas desatendidas This review article appointed to the topic of Neglected Tropical Diseases, a group of 18 disabling pathologies, which are sometimes fatal, and often deforming, that prevail in the populations of Asia, Africa and the tropical areas of South America. We presented, categorized, and analyzed, through a bibliographical review, the elements that relate to these (...) diseases from the Universal Declaration of Bioethics and Human Rights, 2005, in terms of equality, justice and equity, the non-discrimination and stigmatization, social responsibility and health approach. Throughout the review, we concluded that the problem around NTDs is multifactorial and we propose solutions to mitigate and to attend the NTDs, from a perspective of focused bioethics around the dignity of the human person and the affected population. We proposed including bioethics in the debate about the care of the NTDs to analyze the problems and examine solutions through transdisciplinary research projects that involve collaborative and formative work among the affected communities, government entities, health professionals and veterinary sciences. This Article uses age as an entry point for examining how temporal and methodological issues in egalitarianism make substantive equality an unattractive goal for vulnerability theory. Instead, vulnerability theory should adopt a continuous doctrine of sufficiency, which is a better fit with vulnerability theory’s underlying aims and rhetoric. Instead of evaluating what individuals have in relation to others, sufficiency refocuses the inquiry on whether we have enough throughout the lifecourse. "Ontology" focuses on three ways ground and ontology are said to relate. One way involves ground's ability to provide a safe and sane way of admitting certain kinds of things in our theories. Another way involves ground's ability to show how we should measure ontological simplicity. And a third way involves ground's ability to restrict what things or kinds of things can depend on other things or kinds.

One of three basic types of desire, claims Aristotle, is thumos (‘spirit,’ ‘passion,’ ‘heart,’ ‘anger,’ ‘impulse’). The other two are epithumia (‘appetite’) and boulêsis (‘wish,’ ‘rational desire’). Yet, he never gives us an account of thumos; it has also received relatively little scholarly attention. I argue that thumos has two key features. First, it is able to cognize what I call ‘social value,’ the agent’s own perceived standing relative to others in a certain domain. In human animals, shame and honor (...) are especially important manifestations of social value. Second, thumos provides non-rational motivation to pursue what affirms the agent’s social value and avoid what denies it. Interpretations that hold thumos just is anger, or that its object is the fine (kalon), I argue, are mistaken. My account also explains the role of thumos in moral education. In a virtuous agent thumos will be affectively attuned to the correct social rankings; it will take the practically wise, the lovers of the fine, or moral exemplars, as authorities. (shrink)

The reform of the health care system will include a mandate: Individuals are required to purchase health insurance provided that affordable options are available. But what is affordable health insurance? Three accounts of affordability of health coverage have been advanced. The first two accounts are empirical. The third account is needs-based. All three accounts are inadequate. I propose a fourth, the reasonable tradeoff account, according to which individuals should only be required to make reasonable tradeoffs in order to pay for (...) their health coverage. That is, health insurance is affordable if in order to pay for it one does not to have to sacrifice other benefit(s) that are comparable in importance to the benefits of health coverage. (shrink)

In ‘Parental Virtues: A New Way of Thinking about the Morality of Reproductive Actions’ Rosalind McDougall proposes a virtue-based framework to assess the morality of child selection. Applying the virtue-based account to the selection of children with impairments does not lead, according to McDougall, to an unequivocal answer to the morality of selecting impaired children. In ‘Impairment, Flourishing, and the Moral Nature of Parenthood,’ she also applies the virtue-based account to the discussion of child selection, and claims that couples with (...) an impairment are morally justified in selecting a child with the same impairment. This claim, she maintains, reveals that the flourishing of a child should be understood as requiring environment-specific characteristics. I argue that McDougall's argument begs the question. More importantly, it does not do justice to virtue ethics. I also question to what extent a virtue ethics framework can be successfully applied to discussions about the moral permissibility of reproductive actions. (shrink)

In Necessary Existence, Pruss and Rasmussen give an argument for a necessary being employing a modest causal principle. Here I note that, when applied to highly general and fundamental matters, the principle may well be false (or at least not so obvious).

El Foro Global de Bioética en Investigación (GFBR por sus siglas en inglés) se reunió el 3 y 4 de noviembre en Buenos Aires, Argentina, con el objetivo de discutir la ética de la investigación con mujeres embarazadas. El GFBR es una plataforma mundial que congrega a actores clave con el objetivo de promover la investigación realizada de manera ética, fortalecer la ética de la investigación en salud, particularmente en países de ingresos bajos y medios, y promover colaboración entre países (...) del norte y del sur.a Los participantes en el GFBR provenientes de Latinoamérica incluyeron a eticistas, investigadores, miembros de comités de ética y representantes de autoridades sanitarias provenientes de Argentina, Brasil, Chile, Colombia, Ecuador, El Salvador, Guatemala, Honduras, Panamá, Perú, Nicaragua y la República Dominicana. Una legítima preocupación por la protección de las mujeres embarazadas y sus embriones o fetos ha llevado a la mayoría de los países de la Región de las Américas a limitar la realización de estudios con mujeres embarazadas exclusivamente a aquellos estudios específicos sobre el embarazo, y a requerir la exclusión sistemática de las mujeres embarazadas o de las mujeres que quedan embarazadas en el curso del estudio. Ciertamente, a lo largo de la historia de la ética de la investigación, se ha creído erróneamente que proteger a una población es sinónimo de excluirla de los estudios. Se sabe ahora que proceder así implica exponer a riesgos mucho mayores a la población que se busca proteger. El embarazo implica cambios fisiológicos sustantivos e impacta profundamente la manera como el cuerpo metaboliza los medicamentos. Sin embargo, por evitar hacer investigación con mujeres embarazadas, no se ha producido la evidencia científica necesaria para tomar decisiones sobre tratamientos e intervenciones preventivas con dosis eficaces y seguras para ellas y sus embriones o fetos. A manera de ilustración, en el 2001 había en los Estados Unidos apenas más de una docena de medicamentos aprobados para uso en el embarazo (1) y en el 2011 la Food and Drug Administration (FDA) aprobó por primera vez en 15 años un medicamento para su uso en el embarazo (2). Como consecuencia de no haber producido la evidencia necesaria, se pone en riesgo la salud de las mujeres embarazadas cada vez que se les da atención médica. Las mujeres embarazadas se enferman y las mujeres enfermas se embarazan, y no se sabe si los medicamentos que se les da son eficaces o siquiera seguros para ellas y sus embriones o fetos. (shrink)

In a 2014 paper in this journal, I put forward two objections to a version of divine simplicity I call ‘Divine Truthmaker Simplicity’. James Beebe and Timothy Pawl have come to Divine Truthmaker Simplicity’s defense. In this paper, I respond to Beebe and Pawl, consider an overlooked way of defending Divine Truthmaker Simplicity, and conclude by outlining an alternative account of God’s simplicity.
